Agreement to Our Legal Terms
These Terms of Service ("Terms", "Legal Terms") constitute a legally binding agreement between you ("you", "your") and AskToFollow ("Company", "we", "us", "our") concerning your access to and use of our Instagram DM Automation Platform and related services (collectively, the "Services").
AskToFollow lets creators automatically send direct messages to Instagram users who comment on their posts based on customizable automation rules with keyword detection.

BY ACCESSING THE SERVICES, YOU AGREE TO BE BOUND BY THESE LEGAL TERMS. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.
We reserve the right to make changes or modifications to these Legal Terms at any time. We will alert you about changes by updating the "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
The Services are intended for users who are at least 18 years of age. By using the Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

1. Our Services
AskToFollow provides an Instagram DM automation platform that allows you to create automated responses to comments on your Instagram posts. Our Services include:
- Automated direct message sending based on comment triggers
- Customizable automation rules and keyword detection
- Message templates with personalization
- Analytics and engagement tracking
- Meta/Instagram Business account integration
The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.). If your use would be subject to such laws, you may not use the Services.
2. Intellectual Property Rights
Our Intellectual Property
We own or license all intellectual property rights in the Services, including source code, databases, functionality, software, designs, audio, video, text, photographs, graphics, trademarks, service marks, and logos. Our Content is protected by copyright and trademark laws.
Your Use of Our Services
We grant you a non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes only. You may not copy, reproduce, distribute, or exploit any part of the Services without our express written permission.
Your Submissions
By sending us feedback, suggestions, or ideas about the Services, you agree that we may use such submissions for any purpose without compensation to you. You are responsible for ensuring your submissions do not violate any third-party rights or applicable laws.
3. User Representations
By using the Services, you represent and warrant that:
- All registration information you submit is true, accurate, and current
- You will maintain the accuracy of such information and promptly update it as necessary
- You have the legal capacity and agree to comply with these Terms
- You are at least 18 years of age
- You own or have authorization to use the Instagram account(s) connected to the Services
- You will not access the Services through automated or non-human means
- You will not use the Services for any illegal or unauthorized purpose
- Your use will not violate any applicable law, regulation, or Meta's Platform Terms
4. User Registration
You must register an account to use the Services. You agree to:
- Keep your password confidential
- Be responsible for all activity under your account
- Notify us immediately of any unauthorized use of your account
- Connect only Instagram Business or Creator accounts that you own or are authorized to manage
We reserve the right to remove, reclaim, or change a username if we determine it is inappropriate, obscene, or otherwise objectionable.
5. Purchases and Payment
We accept the following forms of payment:
- Visa
- Mastercard
- American Express
You agree to provide current, complete, and accurate purchase and account information. You authorize us to charge your chosen payment provider for all charges at the prices in effect for your purchases.
We reserve the right to correct pricing errors, refuse orders, or limit quantities. All payments are in US dollars unless otherwise specified.
6. Subscriptions
Billing and Renewal
Your subscription will automatically renew unless canceled. You consent to recurring charges without requiring prior approval for each charge. Billing cycles may be monthly or annual, depending on your selected plan.
Cancellation
You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current paid term. No refunds are provided for partial billing periods.
Fee Changes
We may change subscription fees from time to time. We will provide notice of fee changes in accordance with applicable law, and changes will take effect at the start of your next billing cycle.
7. Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to:
- Violate Meta's Platform Terms, Instagram's Terms of Service, or Community Guidelines
- Send spam, unsolicited messages, or engage in abusive behavior
- Collect or harvest user data without proper authorization
- Use the Services to harass, abuse, or harm other users
- Attempt to circumvent rate limits or API restrictions
- Use automated systems beyond the intended functionality of the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services in any manner that could disable, overburden, or impair the platform
- Impersonate another user or entity, or misrepresent your affiliation
- Engage in any activity that violates applicable laws or regulations
8. Instagram API Usage
Our Services integrate with Instagram's API. By using the Services, you acknowledge and agree that:
- Your use is subject to Meta's Platform Terms and Instagram's API Terms
- We access your Instagram data only as authorized by you through Meta's authentication
- You are responsible for ensuring your automated messages comply with Instagram's policies
- We may suspend or terminate your access if your usage violates Meta's policies
- Changes to Instagram's API or policies may affect available features
- You can revoke our access to your Instagram account at any time through Meta's settings
9. User Generated Content
You may create automation rules, message templates, and other content through the Services. You are solely responsible for your content and warrant that:
- Your content does not violate any laws, regulations, or third-party rights
- Your content is not illegal, harassing, hateful, harmful, defamatory, or discriminatory
- Your automated messages comply with applicable anti-spam laws
- You have all necessary rights to use and distribute your content
We reserve the right to remove any content that violates these Terms or applicable laws.
10. Contribution License
You agree that we may access, store, and process any information and personal data you provide in accordance with our Privacy Policy and your account settings. By submitting feedback or suggestions, you grant us the right to use such feedback for any purpose without compensation to you.
11. Social Media Integration
The Services require linking your Instagram Business or Creator account through Meta's authentication. By linking your account, you:
- Grant us access to your Instagram data as specified during authorization
- Represent that you are entitled to grant such access without violating any agreements
- Understand that we may access, store, and process your Instagram content
- Can disable the connection at any time through your account settings
Your relationship with Meta and Instagram is governed solely by your agreements with them, not by these Terms.
12. Third-Party Services
The Services may contain links to third-party websites or integrate with third-party services. We are not responsible for:
- The accuracy, content, or privacy practices of third-party services
- Any products or services offered by third parties
- Changes or interruptions to third-party services
Your use of third-party services is at your own risk and subject to their terms and policies.
13. Service Management
We reserve the right, but not the obligation, to:
- Monitor the Services for violations of these Terms
- Take appropriate legal action against violators
- Refuse, restrict, or disable access to any user or content
- Remove content that is excessive in size or burdensome to our systems
- Manage the Services to protect our rights and ensure proper functioning
14. Privacy Policy
We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. The Services may be hosted in various locations. By accessing the Services, you consent to the transfer and processing of your data as described in our Privacy Policy.
15. Term and Termination
These Terms remain in effect while you use the Services. We reserve the right to deny access, suspend, or terminate your account at any time, without notice or liability, for any reason including:
- Breach of these Terms
- Violation of applicable laws or regulations
- Violation of Meta's or Instagram's policies
- Fraudulent, abusive, or harmful activity
- At our discretion, even without specific cause
Upon termination, your right to use the Services ceases immediately. We may delete your account and all associated data without liability to you.
16. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Services at any time without notice. We may:
- Update features, functionality, or pricing
- Perform maintenance that causes interruptions or delays
- Suspend or discontinue any part of the Services
We are not liable for any modification, suspension, or discontinuance of the Services. We do not guarantee the Services will always be available or error-free.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where AskToFollow is registered, without regard to its conflict of law provisions.
18. Dispute Resolution
If you have any concerns or disputes about the Services, you agree to first try to resolve the dispute informally by contacting us at jithin@asktofollow.com
If a dispute cannot be resolved informally, you agree to submit to the jurisdiction of the courts in our registered location for resolution of any disputes arising from these Terms.
19. Disclaimer
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranties or representations about:
- The accuracy or completeness of the Services' content
- The availability, reliability, or security of the Services
- The results you may obtain from using the Services
- Any errors, bugs, or interruptions being corrected
You use the Services at your sole risk. We are not responsible for any Instagram account issues, suspensions, or violations resulting from your use of the Services.
20. Limitations of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
Our total liability for any claims related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.
Some jurisdictions do not allow certain liability limitations, so some of these limitations may not apply to you.
21. Indemnification
You agree to defend, indemnify, and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your violation of Meta's, Instagram's, or other third-party policies
- Any content you create or distribute through the Services
- Any harm caused to other users through your use of the Services
22. User Data
We will maintain certain data you transmit to the Services for managing performance and your use of the Services. Although we perform regular backups, you are solely responsible for all data you transmit through the Services.
You agree that we shall have no liability for any loss or corruption of your data, and you waive any right of action against us arising from such loss or corruption.
23. Electronic Communications, Transactions, and Signatures
By using the Services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You agree to the use of electronic signatures and electronic records for all transactions through the Services.
24. Miscellaneous
These Terms constitute the entire agreement between you and us regarding the Services. Our failure to exercise any right or provision of these Terms shall not constitute a waiver of such right or provision.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
We may assign our rights and obligations under these Terms. You may not assign these Terms without our prior written consent.
No joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms or use of the Services.
